(क) मौज्दात नभएको वा मौज्दात पर्याप्त नरहेको:
१) “चेक अनादर गरेको व्यहोरा प्रमाणित गर्ने कार्यविधि, २०८२” बमोजिम खातामा रकम मौज्दात नभएको वा मौज्दात भएपनि भुक्तानीका लागि पर्याप्त नभएको अवस्थामा अनादर हुने चेक जारी गर्ने खातावालालाई तथा सोसँग सम्बन्धित पक्षलाई कालोसूचीमा राख्न धारकले सम्बन्धित बैंक वा वित्तीय संस्थासँग निवेदन दिनुपर्नेछ ।
२) कालोसूचीमा राख्न निवेदन दिंदा अनादर भएको चेकको सक्कल प्रतिसहित उक्त चेक अनादर प्रमाणित भएको मितिले ६ महिनाभित्र कालोसूचीमा राख्न सम्बन्धित बैंक तथा वित्तीय संस्थासमक्ष निवेदन दिनुपर्नेछ ।
३) अनादर प्रमाणित भएको चेक जारी गर्ने (उक्त चेक जारी गर्न दस्तखत गर्ने व्यक्ति समेत) व्यक्ति, फर्म, कम्पनी वा संस्था तथा निजसँग सम्बन्धित पक्षहरुलाई कालोसूचीमा राख्न निवेदन प्राप्त भएको ५ कार्यदिन भित्र सम्बन्धित बैंक वा वित्तीय संस्थाले कर्जा सूचना केन्द्रलाई लेखी पठाउनु पर्नेछ ।
(ख) खातामा रकम अपर्याप्त रहेकोमा बाहेक अन्य अवस्थामा:
(१) खातावालाले आफूले जारी गरेको चेकको रकम भुक्तानी नहुँदै खाता बन्द गरेको कारणबाट कुनै चेकको भुक्तानी हुन नसकेको जानकारी प्राप्त हुनासाथ सम्बन्धित बैंक वा वित्तीय संस्थाले कुनै माध्यमबाट सम्बन्धित खातावालालाई प्रचलित कानुनी व्यवस्था अनुसार जानकारी गराउनुपर्नेछ । यसरी जानकारी गराएको अवस्थामा समेत उक्त चेकको भुक्तानी हुने व्यवस्था नगरेको खण्डमा त्यस्तो चेक जारी गर्ने व्यक्ति/फर्म/कम्पनीलाई कालोसूचीमा राख्न सिफारिस गरी पठाउनुपर्नेछ ।
(२) चेकमा गलत हस्ताक्षर गरी चेक भुक्तानी नभएमा:
अ) कुनै व्यक्ति, फर्म, कम्पनी वा संस्थाले जारी गरेको चेकको हस्ताक्षर नमिलेको खण्डमा बैंकले सो चेक धारकलाई चेकको हस्ताक्षर नमिलेको व्यहोरा लिखित रुपमा जानकारी गराउनु पर्नेछ ।
आ) चेक धारकले चेकको हस्ताक्षर नमिलेको व्यहोरा चेक जारी गर्ने व्यक्ति, फर्म, कम्पनी वा संस्थालाई बैंक/वित्तीय संस्था मार्फत जानकारी गराउनुपर्नेछ । चेक जारी गर्ने व्यक्ति, फर्म, कम्पनी वा संस्थाले चेकमा सही हस्ताक्षर नगरेमा वा चेक परिवर्तन नगरेमा धारकले पहिलो पटक चेक पेश गरेको २ कार्यदिन पश्चात् चेकको रकम भुक्तानी गर्नु पर्ने बैंक वा वित्तीय संस्थामा लिखित रुपमा जानकारी दिन सक्नेछ ।
इ) खण्ड आ) बमोजिम लिखित जानकारी प्राप्त भएपछि सम्बन्धित बैंक वा वित्तीय संस्थाले चेक जारी गर्ने त्यस्ता व्यक्ति, फर्म, कम्पनी वा संगठित संस्थालाई चेकको रकम भुक्तानी गर्न सार्वजनिक बिदाबाहेक सात दिनको सूचना दिनुपर्नेछ र सो मितिभित्र पनि रकम भुक्तानी हुन नसकेमा (चेक हराएको, चोरी भएको वा अनधिकृत रुपमा चेक जारी भएको भनी यस बैंक वा कर्जा सूचना केन्द्रको निर्देशिका/कार्यविधिको व्यवस्था अनुसार) त्यस्तो चेक खिच्ने व्यक्ति, फर्म, कम्पनी वा संगठित संस्थालाई उक्त चेक जारी गर्ने बैंक वा वित्तीय संस्थाले अनिवार्य रुपमा कालोसूचीमा सूचीकृत गर्न कर्जा सूचना केन्द्रमा लेखी पठाउनु पर्नेछ । सो अनुसार नगरेमा बैंक तथा वित्तीय संस्थालाई यसै निर्देशन बमोजिम कारवाही हुनेछ ।
(३) कुनै कारण चेक हराएको, चोरी भएको वा अनधिकृत रुपमा प्रयोग गरेर राखेको भनी आधारपूर्ण आधारमा खातावालाले चेक “Stop Payment” गरेको अवस्थामा बाहेक अन्य अवस्थामा चेक जारी गरिसकेपछि “Stop Payment” गरेको भए तापनि त्यस्तो चेक भुक्तानी नभएमा चेक जारी गर्ने व्यक्ति/फर्म/कम्पनी/संगठित संस्थालाई चेकको रकम भुक्तानी गर्न सार्वजनिक बिदाबाहेक सात दिनको समय दिई जानकारी दिनुपर्नेछ । सो मितिभित्र पनि रकम भुक्तानी हुन नसकेमा धारकको अनुरोधमा उक्त चेक जारी गर्ने व्यक्ति वा संस्था तथा सोसँग सम्बन्धित पक्षहरुलाई कालोसूचीमा राख्न कर्जा सूचना केन्द्रमा लेखी पठाउनुपर्नेछ ।
(४) कुनै व्यक्ति, फर्म, कम्पनी वा संगठित संस्थाले धारकले चेकमा उल्लिखित विवरण सही भएको यकिन गर्न सक्ने अवस्था बाहेक अन्य जुनसुकै अवस्थामा फिर्ता हुने चेक जारी गरेमा सम्बन्धित बैंक वा वित्तीय संस्थाले चेक जारी गर्ने त्यस्ता व्यक्ति, फर्म, कम्पनी वा संगठित संस्थालाई चेकको रकम भुक्तानी गर्न सार्वजनिक बिदाबाहेक सात दिनको समय दिई जानकारी दिनुपर्नेछ । सो मितिभित्र पनि रकम भुक्तानी हुन नसकेमा धारकको अनुरोधमा उक्त चेक जारी गर्ने व्यक्ति वा संस्था तथा सोसँग सम्बन्धित पक्षहरुलाई कालोसूचीमा राख्न कर्जा सूचना केन्द्रमा लेखी पठाउनुपर्नेछ ।
(५) उपखण्ड २ (इ) बमोजिमको अवस्थामा चेक भुक्तानी नभई चेक फिर्ता भएको खण्डमा समेत चेक जारी गर्ने बैंक वा वित्तीय संस्थाले उक्त चेक भुक्तानी नभई फिर्ता भएको प्रमाणित गरिदिनु पर्नेछ । उक्त चेक फिर्ता भएको प्रमाणित भएको मितिले ६ महिनाभित्र धारकले चेक जारी गर्ने व्यक्ति, फर्म, कम्पनी वा संस्था तथा निजसँग सम्बन्धित पक्षलाई कालोसूचीमा राख्न सम्बन्धित बैंक वा वित्तीय संस्थालाई निवेदन दिनुपर्नेछ ।
(६) खण्ड (ख) बमोजिम फिर्ता भएको चेक जारी गर्ने (उक्त चेक जारी गर्न दस्तखत गर्ने व्यक्ति समेत) व्यक्ति, फर्म, कम्पनी वा संस्था तथा निजसँग सम्बन्धित पक्षहरुलाई कालोसूचीमा राख्न निवेदन प्राप्त भएको ५ कार्यदिन भित्र सम्बन्धित बैंक वा वित्तीय संस्थाले कर्जा सूचना केन्द्रलाई लेखी पठाउनु पर्नेछ ।
Controlled English translation
(a) Where there is no balance or the balance is insufficient:
1) In accordance with the “Procedure for Certifying Dishonour of Cheque, 2082”, where a cheque is dishonoured because there is no balance in the account or the balance is insufficient for payment, the holder shall submit an application to the concerned bank or financial institution to blacklist the account holder who issued the dishonoured cheque and the related parties.
2) An application for blacklisting shall be submitted to the concerned bank or financial institution, together with the original dishonoured cheque, within six months from the date on which dishonour of the cheque was certified.
3) Within five working days of receiving an application to blacklist the person, firm, company or institution that issued the dishonoured cheque (including the person who signed the cheque) and the related parties, the concerned bank or financial institution shall write to the Credit Information Centre.
(b) In circumstances other than insufficiency of funds in the account:
(1) Where payment of a cheque cannot be made because the account holder closed the account before payment of a cheque issued by him/her, the concerned bank or financial institution shall, immediately upon receiving such information, notify the concerned account holder by any means in accordance with prevailing law. If, even after such notification, arrangements are not made for payment of the cheque, the person/firm/company that issued the cheque shall be recommended for blacklisting.
(2) Where payment is not made because the cheque bears an incorrect signature:
(a) where the signature on a cheque issued by a person, firm, company or institution does not match, the bank shall inform the cheque holder in writing that the signature on the cheque does not match;
(b) the cheque holder shall, through the bank/financial institution, inform the person, firm, company or institution issuing the cheque that the signature does not match. If the person, firm, company or institution issuing the cheque does not sign correctly or replace the cheque, the holder may, after two working days from the first presentation of the cheque, inform in writing the bank or financial institution responsible for payment of the cheque;
(c) upon receipt of written information pursuant to paragraph (b), the concerned bank or financial institution shall give the person, firm, company or organised institution issuing the cheque seven days, excluding public holidays, to pay the amount of the cheque. If payment is still not made within that period, then except where the cheque is lost, stolen or issued without authority in accordance with the relevant directives/procedures of this Bank or the Credit Information Centre, the bank or financial institution on which the cheque is drawn shall mandatorily write to the Credit Information Centre to blacklist the person, firm, company or organised institution issuing the cheque. Failure to do so shall result in action against the bank or financial institution under this Directive.
(3) Except where the account holder has placed a “Stop Payment” instruction on reasonable and substantiated grounds that the cheque has been lost, stolen or used without authority, where “Stop Payment” is made after issuance of the cheque and the cheque is not paid, the person/firm/company/organised institution issuing the cheque shall be given seven days, excluding public holidays, to pay the amount. If payment is still not made within that period, the person or institution issuing the cheque and the related parties shall, upon the holder’s request, be referred to the Credit Information Centre for blacklisting.
(4) Where any person, firm, company or organised institution issues a cheque that is returned in any circumstance other than one in which the holder can verify that the particulars stated in the cheque are correct, the concerned bank or financial institution shall give the person, firm, company or organised institution issuing the cheque seven days, excluding public holidays, to pay the cheque amount. If payment is still not made, the issuing person or institution and the related parties shall, upon the holder’s request, be referred to the Credit Information Centre for blacklisting.
(5) In the circumstance under sub-clause 2(c), where the cheque is returned without payment, the bank or financial institution on which the cheque is drawn shall certify that the cheque was returned unpaid. Within six months from the date of such certification, the holder shall submit an application to the concerned bank or financial institution to blacklist the person, firm, company or institution issuing the cheque and the related parties.
(6) Within five working days of receiving an application to blacklist the person, firm, company or institution issuing a cheque returned under paragraph (b) (including the person who signed the cheque) and the related parties, the concerned bank or financial institution shall write to the Credit Information Centre.
