Employment Classification and Payroll Records in Nepal
The Labour Act identifies forms of employment including regular, work-based, time-bound, casual and part-time arrangements. Select the lawful category from the actual work, duration and relationship. A contract headed “consultant” cannot by itself settle whether a worker is an employee. Control, integration, working arrangements, payment and the applicable statutory provisions require review.
Record the employer, job, start date, category, remuneration, hours and benefits in the employment file. Repeated short contracts for continuing work require scrutiny rather than automatic renewal under the same label. Agency or outsourced labour adds the need to identify the responsible employer and service-provider obligations.
1. Apply the employment definitions
Section 10 of the Labour Act distinguishes regular work from a specified task, a specified period, casual employment and part-time employment. Its definitions include casual work for seven days or less in a month and part-time work requiring thirty-five hours or less in a week. These limits concern the legal classification; they are not permission to remove all remuneration or social-security rights from someone below a threshold.
Section 11 generally requires an employment agreement setting remuneration, benefits and conditions. The statutory exception concerns a written agreement for casual work. A continuing worker should not be left without recorded terms merely because the employer uses an informal arrangement. Section 13 permits probation up to six months, with confirmation when employment is not terminated during the probation period. A contract cannot extend that period indefinitely through repeated renewals.
2. Payroll record chain
| Record | What it supports |
|---|---|
| Appointment/agreement | Employment terms and category |
| Attendance and approved overtime | Payable time and exceptions |
| Pay calculation | Basic pay, allowances and benefits |
| Payslip | Gross earnings, each deduction and net pay |
| Bank/fund/tax records | Actual settlement and statutory remittance |
| Leave and service record | Entitlement and termination calculations |
A payslip should let the employee understand the period, earnings and deductions. Grouping every deduction into “other” conceals whether the amount is tax, social-security contribution, loan recovery or another authorised item. Keep employer contributions distinguishable from employee deductions.
3. Reconcile hours before calculating pay
Separate normal attendance, approved overtime, holiday work, paid leave and unpaid absence. The ordinary limits under section 28 are eight hours daily and forty-eight hours weekly, including the statutory half-hour rest after five continuous hours. Under section 31 the ordinary overtime rate is one-and-a-half times basic remuneration, subject to its specific arrangements. Keep an approved payroll basis and evidence for the hours rather than treating overtime as a discretionary round sum.
A worker changing from part-time to a continuing full-time role needs a documented effective date, revised hours, remuneration and contribution arrangement. Preserve the earlier service history when assessing entitlements. Do not create a new employee identity simply to avoid carrying forward the person's leave, loans or contribution reconciliation. The closing payroll should explain the transition and identify any adjustment to the annual salary-tax estimate.
4. Nepal example
Assume an employee's monthly gross cash earnings are NPR 60,000. Verified deductions comprise NPR 4,400 employee SSF, NPR 2,000 illustrative income-tax withholding and NPR 3,000 authorised loan recovery. Net cash pay is NPR 50,600. Employer contributions are recorded separately and do not reduce net pay again. The assumed figures demonstrate record reconciliation, not a complete entitlement or annual tax computation.
5. Corrections and retention
When attendance or pay changes after processing, retain the original result, approval, revised payslip and accounting adjustment. Do not replace historical slips without a trace. Limit access to payroll information and preserve the records required by labour, tax and scheme law.
Before termination or conversion of an arrangement, review the legal process, notice, accrued entitlements and applicable dispute rights. Classification determines obligations throughout employment; it should be resolved at entry rather than reconstructed when a worker makes a claim. Current minimum remuneration and sector-specific rules must be checked separately before a payroll instruction is released.
