Social Media, Influencer and Creator Income Taxation in Nepal
Income from social media can arise from several arrangements: a domestic sponsorship, an overseas platform payment, an affiliate commission, a licence or a business selling its own products. The tax result follows the actual receipt and taxpayer. A platform name or an online payment description does not establish one universal rate.
1. Identify who earns the income and why
Record the recipient’s legal identity and PAN, the contract, the payer, the activity and the currency. Distinguish an individual’s qualifying foreign receipts from revenue of an operating business or a company. Identify whether the payment is for content creation, a licence, promotional services, commission, goods or another transaction.
Keep domestic sponsorships and foreign-platform settlements separately identifiable. A creator can have more than one type of income in the same year. A tax treatment applying to one receipt should not be carried to the person’s salary, business profit or other investment income without examining those categories.
2. The narrow 5% foreign-receipt category
The IRD FY 2083/84 natural-person notice describes 5% withholding by the relevant bank, financial institution or money-transfer provider on specified foreign-currency receipts of a resident natural person not engaged in operating a business. The listed categories include qualifying software or equivalent electronic services, personal consultancy abroad, and audiovisual content uploaded through social media under sections 95A(6ख), (6ग) and (6घ).
Finance Act 2083 adds these specified receipts to section 92’s final-withholding treatment. Both the category and the recipient conditions matter. Do not describe the rule as a 5% tax on every influencer, every software exporter or every payment received through an international platform. An operating business or a company needs its own income-tax analysis.
3. An illustration of a qualifying receipt
Assume a resident natural person outside an operating business receives NPR 100,000 equivalent in foreign currency for audiovisual content that falls within the reviewed category, and the authorised receiving institution applies 5% withholding. The deduction is NPR 5,000 and the net amount before separate bank charges is NPR 95,000. Retain the institution’s deduction evidence and the records establishing that the receipt qualifies.
The example does not establish that a particular creator meets the conditions. If the creator also receives a domestic sponsorship or operates a trading business, classify and compute those receipts separately. Final withholding for the specified foreign receipt does not decide the treatment or filing obligations arising from other income.
4. Reconcile the platform statement to the bank
Keep the earnings statement, payout period, gross amount, platform fee, withholding, exchange conversion and net settlement. Explain reversals and adjustments rather than using only the net bank deposit as revenue. Where an amount is earned but paid later, retain the dates and accounting basis supporting its treatment.
For affiliate commissions and sponsored content, retain the agreement, invoice, proof of the deliverable and any payer withholding certificate. If a payment includes more than one component, separate the rights or services actually supplied. A contract labelled “advertising” may also grant a licence or reimburse a cost; the full terms matter.
5. Review business expenses and non-cash benefits separately
A creator operating a business should keep evidence of equipment, production, staff, platform, travel and other costs and distinguish business use from private use. A purchased camera, phone or computer can raise capitalisation and tax-depreciation questions. A free product, barter arrangement or other non-cash consideration should be identified instead of disappearing from the receipt records.
VAT registration, invoicing and the treatment of a supply are separate questions from income-tax withholding. Use the current threshold and mandatory-category rules for the actual activity. Receiving an amount after withholding does not by itself settle VAT eligibility or remove the need for proper records.
6. Prepare the year-end working
Reconcile each receipt category, expenses where relevant, payment credits and any final-withholding records to the taxpayer and income year. Preserve the current-year source set and the reason for each classification. If the person’s operating status, payer contract or receipt category is unclear, resolve that issue before applying the narrow 5% treatment.
Retain prior-year workings under their own law. A later amendment or a platform changing its payout method should trigger a review of the affected receipts, without silently changing the tax explanation for an earlier year.
