Prizes, Windfall Gains and Casino Activity — Nepal Tax and Licensing Distinctions

A windfall receipt and a licensed gaming business are different tax questions. Classify the prize and its recipient separately from the operator’s licence, royalty and other business obligations.

1. The receipt and the business have separate rules

A prize or windfall receipt and operation of a casino/gaming business are different legal questions. Determine the recipient, payment category, source, amount and year for taxation, and separately establish the operator's permitted activity, licence, renewal and sector obligations. A withholding deposit does not authorise an otherwise unlicensed activity.

The Income Tax Act contains windfall-gain collection provisions and specified exceptions. Finance Act 2083 changes the wording to include agriculture in the relevant award exceptions. Apply the exact award conditions rather than assume every agricultural payment or prize is exempt.

2. Receipt file

For arithmetic only, assume a reviewed payment of NPR 100,000 with 25% withholding. Deduction is NPR 25,000 and net cash NPR 75,000. The assumed rate demonstrates settlement; the actual category and current statutory rate must be verified before use.

3. Operator compliance

Casino/gaming operations require current tourism/sector permissions, fees and conditions, tax records, customer controls and applicable AML duties. Record the precise activity and premises. A hospitality licence should not be presented as permission for casino operations.

4. Nepal example

A hotel hosts a promotional competition. It must classify the prize and withholding separately from its room and restaurant revenue. It should not call the event a casino or use a casino rule merely because customers can win a prize. Conversely, a licensed gaming operator must meet its own sector obligations beyond paying tax on winnings.

5. Review

Keep event rules, award authority, recipient evidence, payment certificates and operator permissions where relevant. Check current rates, sector fees and licensing conditions for the actual payment and activity.

6. Windfall tax and the award exceptions

Section 88A starts with 25% withholding on windfall gains. It contains specified award exceptions rather than a general exemption for gifts or prizes. Finance Act 2083 adds agriculture to the listed fields alongside literature, arts, culture, sports, journalism, science, technology and public administration. Identify the qualifying contribution and award terms; ordinary sales incentives or a commercial lottery do not become exempt merely because the organiser promotes a cultural cause. The provision distinguishes a qualifying national or international award of up to NPR 500,000 and the excess above that amount. Suppose a payment is independently established to qualify under that statutory award category and totals NPR 700,000. The excess is NPR 200,000; at 25%, the illustrative withholding on that excess is NPR 50,000. If the payment does not qualify for the exception, that calculation does not establish its liability. The Act also permits a government-gazette exemption for specified awards. Retain the actual notice if relied upon. A press release congratulating the winner is not a substitute for the legal exemption.

7. Casino operator obligations

Finance Act 2083 section 22 sets the casino royalty framework separately: NPR 55,000,000 annually for the stated casino category and NPR 30,000,000 for games conducted solely using modern machines or equipment. The Act addresses the licence location and instalment payment requirements. Operating permission, royalty, income tax, VAT treatment, withholding and AML duties remain distinct responsibilities. A winner’s withholding voucher does not demonstrate that the venue held a valid licence or paid its royalty. Conversely, an operator’s royalty payment does not settle the income-tax treatment of every patron’s receipt. Maintain separate files for operating authority and customer payments, including the evidence appropriate to regulated gaming activity.

8. Reporting the outcome

Record gross prize, any exempt portion, withholding base, deduction and net payment. Identify finality under section 92 and provide the relevant certificate. For a foreign recipient, determine source and applicable provisions separately. Do not infer that a foreign passport or a cash payout removes Nepal tax obligations.
