Finding the Right Company, Labour and Social Security Documents
A company’s legal records, employment obligations and social-security arrangements overlap in daily work, but they answer different questions. A company registration certificate does not establish that employment or SSF records are complete. Prepare a source file for each obligation and connect them through the entity and employee identifiers.
1. Start with the decision being made
For a company matter, identify whether the question concerns a statutory obligation, an OCR filing, a constitutional document, a board decision or financial distress. Read the applicable company law with the entity’s memorandum and articles. Keep insolvency questions separate from routine changes to registered particulars; the consequences and required advice can be quite different.
For employment matters, first establish the working arrangement and the relevant period. Retain the employment agreement, remuneration structure, attendance, leave record and any sector-specific requirements. Use the applicable Labour Act, Rules and official standards alongside these facts. A payroll spreadsheet is evidence of a computation, not the complete employment record.
2. Choose the SSF procedure by participant type
Formal employment, domestic self-employment, informal work and foreign employment have distinct source documents. Select the arrangement before applying a contribution percentage or claiming a benefit. A rule for one scheme should not be carried into another because both documents carry the SSF name.
For a monthly reconciliation, match employee identification, the contribution period, the contribution basis, the payroll deduction, the employer payment and the Fund statement. Investigate gaps at the individual level. A total payment agreeing to the bank does not establish that every contributor received the correct credit.
3. Connect decisions to evidence
Suppose an employee leaves the company during the year. The working file may need a board or management authorisation, an employment settlement, payroll treatment, social-security reconciliation and tax documentation. These are related records, but one approval should not be treated as a substitute for all the others.
Keep copies of filed returns, acknowledgements and correspondence separately from draft calculations. Record the version of each procedure used and check later notices before filing or paying. Where eligibility, a dispute or financial distress is involved, obtain advice on the actual facts rather than treating a general guide as a determination.
4. Make the document version visible in the employee file
Use the cited Ministry of Law consolidation through Chaitra2081 for current company-law research. An edition amended only to2075 is insufficient for a current corporate decision. Preserve earlier editions for historical work and identify the actual edition and amendment date in the decision file.
For formal-sector social-security benefits, the current scheme procedure is the fifth-amendment edition. Its benefit conditions are separate from the contribution-based Social Security Act and from the procedures for other participant groups. Record the scheme and amendment in the claim file before testing contribution history, the event and the claimant’s eligibility.
Consider a departing employee with several months of unmatched contributions. Reconcile the employee number, eligible remuneration, deduction, employer contribution, remittance and Fund credit for each month. An employer’s bank transfer is not enough if the employee-level record still shows a gap. Keep the correction correspondence with the final settlement.
Complete the employment decision, payroll settlement and Fund reconciliation as separate workstreams. The employee’s signed receipt confirms the amounts described in it; it does not establish that a statutory entitlement was calculated correctly or that an omitted Fund contribution has been credited. Escalate those discrepancies before closing the file.
