Employee Benefits in Kind, Loans and Reimbursements — Nepal Payroll Classification

Cash salary, a company-provided benefit, employee loan and business reimbursement require different analysis. Determine ownership, private use, employment connection, repayment terms and supporting expense. A payment called “reimbursement” is not automatically excluded from employment income if it is actually a personal benefit or unsupported allowance.

Use the Income Tax Act's employment-income inclusion and valuation rules, current annual amendments and the Labour Act for entitlement. Employee shares and rights need separate analysis under the current applicable provisions; a rule for a specified sector should not be generalised to every share award.

1. Classify and trace benefits

Loan principal advanced is not ordinary salary merely because it appears in payroll. A subsidised loan can create a distinct benefit question. Loan recovery is also different from income-tax withholding.

Follow a benefit through the records

For each benefit, identify the recipient, the period, the reason for provision and whether there is an employee contribution. Connect the employment agreement or policy to the invoice, asset record, expense claim or loan agreement. The payroll tax entry should follow the supported classification and applicable valuation rule. It should not be selected merely because the accounts team has used the same ledger code in previous years.

A company vehicle may support business travel and private use. Record ownership, the authorised user and the evidence relevant to the statutory valuation. A housing arrangement requires its own terms and period. Do not apply a vehicle valuation to accommodation or a general accounting depreciation amount to every non-cash benefit. If the employer pays an employee's personal bill, retain the bill and identify the benefit explicitly rather than disguising it as office expenditure.

2. Specific IT sweat-share exclusion

A specific IT employment exclusion

Finance Act 2083 section 57(3) adds an IT employment sweat-share provision to Income Tax Act section 8(3)(ङ), which is an employment-income exclusion provision. It should not be described as a new taxable inclusion. Apply the exact eligible industry, instrument and employment facts before excluding an amount; this limited provision is not a general exemption for every employee share award. Keep the award terms and calculation with the employee's annual tax file.

3. Loan and reimbursement examples

Loan and reimbursement example

Suppose an employer advances NPR 200,000 under a written employee-loan agreement and recovers NPR 10,000 each month. Record the NPR 200,000 as a receivable, and the recovery against that receivable. Determine any concessionary-interest benefit separately under the relevant tax rule. Showing the advance as salary and then claiming each repayment as a salary deduction would obscure the transaction and distort the employee's annual record.

For reimbursement, an approval is only one part of the evidence. Match the traveller, business purpose, dates, receipts and amount paid; identify advances and returns of unused cash. A receipt for NPR 18,000 against a NPR 20,000 advance leaves NPR 2,000 to be returned or otherwise classified. Keep that balance visible. A fixed allowance that continues regardless of actual expense deserves a separate classification from repayment of supported business costs.

Nepal example

An employee submits NPR 20,000 of supported business travel and receives a NPR 10,000 flat personal allowance. The payroll file separates the two, tests the reimbursement evidence and applies the correct employment-income treatment to the allowance. Combining them into one NPR 30,000 “travel reimbursement” obscures the decision.

4. Controls and annual reconciliation

Controls

Document policy, approvals, receipts, repayment schedule and valuation. Reconcile benefit values to the annual payroll-tax computation, even when no cash passes through the monthly payslip. Track outstanding employee loans independently of salary expense.

Year-end

Review benefits and reimbursements across departments so private use is not missed. Apply the current income-year law and supported valuation assumptions. Before filing, resolve the exact statutory valuation and the employee’s circumstances; this classification guide does not prescribe one value for every benefit.

Close the annual benefit schedule

Combine recurring payroll items with benefits recorded outside payroll, including purchases by administration and amounts charged through directors' or staff accounts. Reconcile the schedule to the employee's annual income calculation and explain each valuation assumption. Give the reviewer the relevant law and evidence so the conclusion can be repeated next year. Where a receipt or valuation is unresolved, record the exception and obtain a decision before finalising the employee's tax statement.
