Sector & Operational Compliance

Education and Healthcare Businesses in Nepal — Legal Form, Supplies and Sector Permissions

1. Sector purpose does not settle every tax

A school, college, training business, hospital, clinic, pharmacy and diagnostic provider can have different legal forms and supplies. Determine the actual activity, owner, licences and receipts before selecting tax treatment. A sector exemption, where applicable, does not automatically cover ancillary sales, rent, investment income or every payment obligation.

Use current VAT schedules, income-tax provisions, sector legislation and competent authority requirements. A public-trust school category in the entity-rate schedule is not a universal rate for every educational company.

Do not label all receipts “fees exempt” without the exact current schedule entry. Product sales and services may have distinct treatment. Imported equipment concessions also require the eligible importer/product and approval.

3. Nepal example

A clinic earns consultation fees, operates a pharmacy and rents space to another provider. The accountant classifies each activity separately for VAT and income tax and maintains inventory for medicines. The consultation label does not establish treatment for rent and product sales.

A training company receives advance course fees for a programme beginning later. Accounting recognition, VAT timing and refund obligations require separate analysis. Cash received is not automatically current profit.

4. Controls

Reconcile fee/billing systems to ledger, bank and tax returns. Document concessions, refunds, restricted funds and related-party payments. Maintain payroll, professional-service withholding and licence renewals. Protect personal records and separate clinical/student information from ordinary financial access where appropriate.

5. Scope and current requirements

For an actual institution, check the competent sector authority, location, permitted activities and the exact tax treatment of each supply. This article explains the activity-by-activity compliance map and examples; it does not treat the institution’s name as proof of an exemption or an operating licence.

6. Separate commercial billing from a claimed exemption

Finance Act 2083 replaces the VAT exempt Schedule 1. A historical statement that a broad “education” or “healthcare” sector is exempt is not enough for an individual current supply. Match the particular service or goods to the current entry and retain the facts supporting that classification.

A clinic’s consultation, medicine sale, diagnostic service and rental receipt should be separately identifiable in the billing and ledger system. A school or training business should distinguish the tuition service, accommodation, transport, book sales and other receipts where present. This makes it possible to explain why different receipts have different treatment without forcing them into one sales account.

For advance fees, retain the service period, contract, cancellation terms and refund record. Accounting recognition, tax timing and a customer refund are different questions. Reconcile refunds to the original payment and billing record, and document who authorised a waiver or concession.

Licensing should identify the actual entity, location, facility and activity covered. A professional’s personal registration is not necessarily the facility’s operating permission, and a permitted core activity does not authorise every ancillary sale. Keep licence and renewal evidence separate from the tax exemption analysis, and review a new service or premises before treating the previous permission as sufficient.
