Tax and Regulatory Updates — Source Review, 12 October 2026

This page records the main source versions checked for this Knowledge Centre collection. Each entry distinguishes the date of the source from the date the article was revised. Use the detailed article for conditions and documents; a short update does not establish that a particular transaction qualifies.

The collection is a dated editorial snapshot. Later notices, amendments, extensions or sector instructions must be checked before a filing or transaction. An article correction is not necessarily a newly enacted rule.

Article corrections — 13 October 2026

1. Income tax and VAT: FY 2083/84 sources

The tax review compared the relevant Income Tax Act and VAT Act provisions with Finance Act 2083 and the published VAT Rules including the twenty-seventh amendment. The individual and couple rate guides use the FY 2083/84 bands. The deductions, retirement contributions and medical credit are separate tests; their eligibility should not be inferred from the rate table alone.

Existing VAT registration copy was corrected to the NPR 3 million ordinary services and mixed-supply threshold. Goods, transport vehicle rental and transport services use the NPR 5 million category, subject to the registration rules. Mandatory-registration categories need separate examination. Exporter refund guidance now uses the strict boundary of exports exceeding 40% of monthly sales.

The contract TDS guide now explains the preceding ten-day aggregation test in section 89(2), rather than a permanent total for the entire contract. The five-year income-tax refund guide uses the specific reference dates in section 113(4). These entries identify corrections to the guides; they do not describe all Finance Act changes.

2. Non-resident digital services

The non-resident VAT and digital-service-tax guides now have separate full articles. Their registration, base, business-customer exclusions, rates and filing cycles differ. The 3 Bhadra 2083 clarification concerning the VAT return schedule and negative-credit-note treatment was read with the operating procedure. It is not treated as a suspension of digital-service VAT.

A Nepal business buying a foreign service should separately examine imported-service VAT and withholding. Consumer-facing registration rules should not be substituted for the business purchaser’s duties. Identify the customer’s status, service rights, income source and relevant treaty before applying the detailed guide.

3. Foreign exchange: 5 October 2026 circular

The FX articles use the Unified Circular 2082 together with subsequent amendments, including Circular 2/2083–84 dated 5 October 2026. For the qualifying foreign-service category, the reviewed bank delegation is USD 30,000 per payment, subject to its documentation and other conditions. A monetary limit alone is not permission to remit.

The same amendment addresses goods payments through Draft/TT and reporting of monthly advance payments. FDI inflow, recording, repatriation and foreign loans are separately governed by the Foreign Investment and Foreign Loan Management Bylaw, including its fifth amendment. Approval, recording and bank settlement must remain distinct.

4. Financial reporting and assurance

ASB’s published notice makes NFRS 2024 mandatory from 1 Shrawan 2082. The reporting framework must still be selected for the entity, its activities and regulatory status. The micro-entity and SME guidance records the relevant amended classification conditions; these are not tax turnover thresholds.

The NIA NFRS 17 implementation guideline 2083 and ICAN’s December 2025 suspicious-transaction guidance were checked for their stated reporting duties. Specific accounting models, regulatory extensions, sector directives and transaction decisions remain subject to the detailed review questions. Exposure drafts are not presented as mandatory standards.

5. Foreign-investment sources

The automatic-route guidance now cites the Gazette dated 2082/11/04, which lists 102 industry areas across seven categories, removes the automatic-route maximum and separately exempts the listed IT-based category from the minimum foreign-investment amount. The negative list and other approval requirements still apply.

The ordinary minimum-investment discussion cites the original Gazette dated 2079/07/28 and distinguishes the amount per foreign investor from the company’s total capital. The agriculture exception uses the at-least-75% export boundary in the relevant Gazette. Current FITTA amendments and project-specific eligibility still require the recorded review.

6. How an article correction is recorded

Each article shows its latest editorial date, C.M. & Associates attribution and latest update details. Source versions and any outstanding issue remain identified in the article. An editorial date does not establish that every provision was reverified or that a professional approved the text.

When a new source changes a published article, preserve the earlier text and source reference privately, identify the corrected paragraph and record the applicable period. Update the linked resource pages and related articles where the same rule appears. Do not publish a changed rate without checking the worked example and conclusion.
