Treaty Residency, Relief and Mutual Agreement Procedure — Nepal Evidence Sequence
Treaty relief requires the actual treaty, recipient, income and period. A residence certificate supports one part of the file; it does not prove every condition for a reduced withholding rate.
1. Domestic source and treaty relief are separate tests
Determine domestic residency, income character and source before analysing a treaty. Then establish that the treaty is in force for the person, tax, income and period. Different treaties can use different language; a clause from one country pair must not be copied into another claim.
A residence certificate supports a specified period and person. It does not automatically prove beneficial ownership, absence of a PE or satisfaction of anti-abuse conditions. An intermediary receiving a payment may not be the person entitled to relief.
2. Treaty file
| Question | Evidence |
|---|---|
| Domestic treatment | Source, classification and ordinary tax/withholding |
| Treaty eligibility | Exact treaty, effective status and covered person |
| Residence | Official certificate and supporting facts |
| Income article | Business profit, royalty, interest, employment, gain or other category |
| Conditions | PE, beneficial ownership and relevant anti-abuse provisions |
| Claim/reporting | Required forms, withholding and return reconciliation |
Do not claim “no Nepal tax” merely because the recipient is treaty-resident. The treaty article and facts determine whether Nepal retains a taxing right and any limit.
3. Nepal example
A Nepal payer remits a licence fee to a foreign company. The file analyses domestic royalty/source treatment, the actual treaty royalty article, the recipient's residence and ownership of the income, and any PE connection. A certificate supplied by another group company is not automatically usable by the invoicing recipient.
4. MAP and disputes
Where taxation may be inconsistent with an applicable treaty, consider the treaty's mutual agreement procedure, competent authority and time limit. MAP availability and interaction with domestic review/appeal depend on the exact treaty and law. Filing a MAP request does not automatically stop a domestic deadline or guarantee relief.
5. Close the analysis
Preserve gross income, tax deducted or paid, foreign tax and relief claimed. Explain differences between domestic and treaty outcomes with the supporting treaty article. Verify the named country’s current treaty status and claim requirements before seeking relief.
6. Determine which treaty article applies
Classify the income before choosing an article. Business profits, employment, interest, royalties, dividends and capital gains can have different treaty provisions. Identify the payer, actual recipient, rights or services and Nepal activity. A consultancy invoice involving software rights may need more than an ordinary-business-profit assertion. Read the treaty in force for the country pair and relevant period, including any applicable protocol. Preserve the official text and residence evidence. Check whether relief depends on beneficial ownership, a PE, a holding condition or another test. Nepal’s section 73 also contains restrictions relevant to certain entities; foreign incorporation alone does not prove entitlement. Suppose a gross payment is NPR 1,000,000 and a reviewer establishes that an applicable treaty permits 10% withholding on that precise income. The illustrative deduction is NPR 100,000. Without that eligibility analysis,10% is simply an assumed arithmetic rate and should not be used in the payment file. If the contract promises a net amount, analyse gross-up separately.
7. MAP does not automatically suspend tax
A mutual-agreement procedure addresses the treaty’s specified dispute route through competent authorities. Identify its time limit, authority, covered issue and documentary requirements from the actual treaty and operative instructions. A normal office complaint or domestic appeal is not automatically a MAP application. Record assessments, withholding, payment, domestic proceedings, residence evidence, treaty provisions and the claimed double taxation. Explain why the treaty is engaged. Keep filing evidence and protect applicable domestic deadlines separately; initiating one remedy should not be assumed to preserve or stay every other process.
8. Follow the outcome through the accounts
If relief is granted, trace the adjustment or refund to the original income and tax payment. Retain the decision, not only correspondence acknowledging receipt of the request. Foreign-tax-credit treatment may also need revision after a foreign refund. A credit computation using foreign tax that has subsequently been returned can overstate the remaining relief.
