Public Procurement and Government Contractors — Nepal Bid-to-Payment Records

1. Follow the authority and contract

Public procurement involves bidder eligibility, solicitation documents, evaluation, award, contract, performance and payment under the applicable law and rules. e-GP is a submission channel; it does not replace the bid's legal and documentary requirements. A successful upload is not a contract award.

Use the current PPMO standard documents, rules and procurement notice. Identify the procuring entity, method, deadline, security, qualifications and contract conditions. Avoid reusing an old bid document without checking the current notice and amendments.

2. Bid-to-payment file

StageEvidence
EligibilityRegistration, qualifications and required certificates
BidCurrent documents, authority, price and security
SubmissionAcknowledgement and permitted amendments
AwardDecision, notification and executed contract
PerformanceDeliveries, certification and authorised variations
PaymentInvoice, deductions, retention and settlement

A contract variation requires the applicable authority and procedure. Site-level agreement is not always authority to alter price or scope. Preserve the approved variation and its effect on securities, completion and payment.

3. Nepal example

A contractor submits a bid and later receives an instruction to perform additional work. It checks the contract and approval route, obtains the authorised variation and records cost and certification separately. It should not rely only on an informal instruction and assume the additional amount will be paid.

4. Review and remedies

Retain procurement notices, amendments, correspondence and decisions with service dates. Bid review, blacklisting, contract dispute and tax appeal are different routes with different conditions. Use the current forum and deadline rather than one generic “appeal period.”

5. Current procurement documents and bid deadlines

Use the current PPMO Act, Rules, notices and standard bidding documents. The publication list includes the 2083 amendment sequence; choose the operative provisions and documents applicable to the particular procurement.

PPMO's urgent e-GP bidder notice is an official source for bid-submission timing. Keep the notice with the bid's own deadline and amendments. Check the calendar, holidays and any issued extension before treating a saved date as the operative closing time. The publication dates and governing scope of a general notice and a particular procurement should be recorded separately.

A useful bid-control record contains the solicitation number, procuring entity, applicable standard document/version, published closing date/time, amendments, security validity, submission acknowledgement and authorised signatory. After award, add the signed contract, performance security, insurance, approved variations, certified work and payment records. Review the legal relationship between extension of completion time and continuation of the securities; neither should be assumed from an informal site instruction.

Check current statutory thresholds, review periods and the specific contract conditions in the complete applicable documents. Retain the provision and version relied upon with the procurement file.

6. Reconcile the contract to the certified payment

Keep the awarded price, authorised variation, certified work, retention, taxes deducted and cash received in a single contract reconciliation. A payment certificate and a bank receipt may describe different amounts because of retention, withholding, advance recovery or disputed work. Each difference should have an explanation and supporting record.

Record an instruction for additional work with the person issuing it, the contractual authority, scope, estimated effect and approval status. Until the required authority and valuation are established, distinguish proposed additional work from an approved contract variation. A contractor’s internal invoice does not establish that the procuring entity accepted the additional amount.

Security records should show the instrument, issuer, beneficiary, amount, validity, required extension and release. Connect any completion-date change to the relevant security and insurance conditions. Do not treat an extension of time as evidence that every linked instrument was extended automatically.

For review or dispute, preserve the notice, service date, procurement stage, forum and the exact current rule. The sixteenth-amendment Rules are a current source edition in the PPMO index, but the applicable deadline and remedy must come from the actual operative provision and procurement stage. Keep an issue open where the full provision or required decision has not been obtained.
